Part 1: Attendance - Texas Compulsory Attendance Cheat Sheet SMART TIP: Remember, if parents don't respond to a warning letter, you can still try other solutions such as:
(see section 5 for a sample attendance contract) 1. The law requires a student between the ages of 6 and 18, as well as students enrolled in prekindergarten and kindergarten, to attend school and District-required tutorial sessions unless the student is otherwise legally exempted or excused. (§ 25.085) 2. A student may not be given credit for a subject unless they have attended 90% of the classes for that year. (§ 25.092) 3. If a student is absent without excuse for three or more days or parts of days within a month, the school will send a warning letter to the parents stating that they may be filed on in a court of law for a criminal truancy charge (filing is still optional). (§ 25.095) 4. If a parent does not respond to warning letters that parent may be charged with a criminal offense. (§ 25.093) 5. If a student is absent without excused for ten or more days or parts of days within a six-month period, the school must file criminal truancy charges on the parent (s) and student.
